These Terms govern your use of the SmartKDP website, tools, and applications (the "Service"). By creating an account or making a purchase you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.
The short version
This section is a summary for orientation, not a substitute for the rest. Where it differs from the detail below, the detail wins.
- You keep ownership of everything you create with SmartKDP, including the books you publish.
- Payments are handled by Lemon Squeezy, our merchant of record — your statement will show Lemon Squeezy (often "LS*" or "LEMONSQUEEZY").
- Subscriptions renew automatically until you cancel. Cancelling takes a couple of clicks in your account — you never have to email us.
- There is a 7-day money-back guarantee on your first purchase.
- We are a tool. You remain responsible for your own Amazon KDP account and for what you publish.
- We are not affiliated with Amazon.
Your account
You need an account to use most of the Service. You must give accurate information, keep your credentials secure, and are responsible for activity under your account. Tell us promptly at support@smartkdp.com if you suspect unauthorised use.
You must be at least 16, and old enough to enter a binding contract where you live.
Plans, pricing, and payment
What you are buying
We offer subscription plans billed monthly or annually, and one-time purchases including lifetime products. The plans, their limits, and the current prices are shown on our Pricing page and again at checkout before you pay. The price shown at checkout is the price you pay, in your local currency where we can display it, inclusive of any sales tax or VAT that applies where you are.
Who you are paying
Our order process is conducted by our online reseller Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. Lemon Squeezy provides all customer service enquiries and handles returns.
In plain terms: when you buy a subscription or a lifetime product, your contract of sale for that purchase is with Lemon Squeezy, not with us. Lemon Squeezy takes the payment, determines and remits any sales tax or VAT owed in your country, and issues your receipt. Your bank or card statement will show Lemon Squeezy, usually alongside our name — that is expected, not an unrecognised charge.
Your use of the Service itself remains governed by these Terms with us. Lemon Squeezy's own terms and privacy notice cover the payment transaction. Lemon Squeezy offers card, PayPal, and other payment methods depending on your country; we never see or store your card details.
Automatic renewal
Subscriptions renew automatically. When you subscribe, you are authorising Lemon Squeezy, as merchant of record, to charge your payment method the subscription amount, at the interval shown at checkout, on each renewal date, until you cancel. We tell you the amount, the interval, and the first charge date on the checkout page before you confirm.
To cancel, go to Account → Billing and cancel your subscription. It takes effect at the end of your current paid period; you keep access until then, and you are not charged again. You do not need to contact support, and we will never make cancelling harder than subscribing.
If a renewal payment fails, we will retry and email you. If it stays unpaid past a short grace period, your paid features are suspended until payment succeeds.
Price changes
If we change the price of a plan you are on, we will give you notice by email before it applies to you, and it will only take effect at your next renewal. You can cancel before then.
What "lifetime" means
Because ambiguity here causes real disputes, we state it exactly:
A lifetime product is a permanent unlock of a defined set of features, for the lifetime of the product, subject to fair-use caps on usage. It is not unlimited usage. It does not include collaboration or team features, the AI Listing Studio, research features, or subscription-tier bulk generation capacity.
Which features and caps your lifetime purchase includes are listed on the product at the time you buy, and that is the version that applies to you. "Lifetime" refers to the lifetime of the product; if we ever discontinue it, we will give reasonable notice and a fair transition.
Refunds
Our refund terms, including the 7-day money-back guarantee and the statutory rights of consumers in the EU and UK, are set out in the Refund Policy, which forms part of these Terms.
Usage limits and fair use
Plans include quotas — for example puzzle generations, AI calls, projects, and storage. Quotas are shown on the pricing page and in your account. Where a plan is described as unlimited, that means unlimited ordinary individual use, not automated or bulk use at a scale that degrades the Service for others.
You may not attempt to circumvent quotas, share one account across multiple people to avoid paying for seats, or use automated means to access the Service beyond any published API.
Your content
You own your content. Everything you upload and everything you create with SmartKDP — your projects, puzzle sets, and finished books — remains yours. Publishing rights and royalties from anything you publish are entirely yours.
To run the Service, you grant us a limited, non-exclusive, worldwide licence to host, store, copy, transmit, render, and process your content, solely so we can provide the Service to you. That licence ends when you delete the content or your account, except for backups that age out on their normal cycle.
You are responsible for having the rights to what you upload. You may not upload content that infringes anyone's copyright or trademark, is unlawful, or breaches our Acceptable Use Policy, which forms part of these Terms.

Amazon KDP and what we do not guarantee
SmartKDP is an independent tool. We are not affiliated with, endorsed by, or sponsored by Amazon.com, Inc., and "Amazon", "Kindle", and "KDP" are their trademarks, referred to here only to describe what our tools are for.
That has practical consequences you should be clear about:
- You are the publisher. You are responsible for your own KDP account, for complying with Amazon's terms and content policies, and for what you publish.
- Our preflight checks are assistance, not a guarantee. Passing our KDP preflight does not guarantee that Amazon will accept your file. Amazon sets its own requirements and can change them or reject a submission for reasons outside our checks.
- Estimates are estimates. Royalty, cover-dimension, and sales-rank calculators produce estimates based on published formulas and assumptions. They are not Amazon-verified figures and should not be your only basis for a business decision.
- AI-assisted output is your responsibility to review. Where the Service generates text or ideas, verify it before publishing. We make no promise that output is unique, accurate, or registrable, and the copyright status of purely AI-generated material is unsettled in several jurisdictions. Where a marketplace requires you to disclose AI involvement, that disclosure is yours to make.
Availability and changes to the Service
We aim for the Service to be available and reliable, but we do not promise uninterrupted availability. We may add, change, or remove features. If we remove something significant that you paid for, we will give reasonable notice and, where fair, a pro-rata refund.
Suspension and termination
You can stop using the Service and delete your account at any time.
We may suspend or terminate an account that materially breaches these Terms or the Acceptable Use Policy, that we reasonably believe is being used unlawfully, or where payment stays unresolved. Except where the breach is serious or unlawful, we will tell you and give you a chance to put it right first. If we terminate your account without cause, we will refund the unused portion of anything prepaid.
On termination, you can export your work. We will keep it available for a reasonable period before deletion.
Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, or that any particular commercial result will follow from using it.
Nothing here excludes liability that cannot be excluded by law, and nothing here affects the statutory rights you have as a consumer.
Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits, lost revenue, or lost data.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars.
Again, this does not limit liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited — and if you are a consumer, your statutory rights are unaffected.
Indemnity
You agree to indemnify us against third-party claims arising from your content, from what you publish, or from your breach of these Terms or the Acceptable Use Policy. This does not apply where the claim arises from our own breach.
Governing law and disputes
These Terms are governed by the law of the jurisdiction stated on our Contact page, and the courts there have jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory rules of the law of your country of residence, or of your right to bring proceedings there.

Changes to these Terms
We may update these Terms. If a change is material, we will update the version and effective date above and notify account holders by email before it takes effect. Continuing to use the Service after that means you accept the updated Terms. If you do not, you may cancel and, where the change materially disadvantages you mid-term, request a pro-rata refund.
The whole agreement
These Terms, together with the Privacy Policy, Refund Policy, and Acceptable Use Policy, are the entire agreement between us about the Service. If any provision is held unenforceable, the rest stands.
